RESOURCES FOR ALL MUNICIPALITIES

Nyhart 2016 Indiana Health Care Survey: The Nyhart Company’s annual survey of healthcare costs and design features for Indiana employers reflects information from 328 Indiana-based employers and more than 18,000 employees.

IRS Opt-out Payments: On July 8, 2016, the IRS issued proposed regulations on opt-out payments that are important for municipalities with at least 50 full-time equivalent employees.

Municipalities and Medicare: Indiana municipalities often ask whether it’s possible to take Medicare “into account” when determining eligibility under a group health plan. This article provides an overview of this complicated area of law.

Buyer Beware: Medicare Cost Plus: Under the Medicare Cost Plus approach, a municipality with a self-funded plan elects to set its own price for medical procedures that is slightly higher than the amount that Medicare would pay for the same procedure. While this may sound enticing, all municipalities need to understand the political and legal risks associated with the MCP approach.

Providers and MCP Arrangements: Very few, if any, Indiana community hospitals will accept payments under a MCP arrangement as full payment for services provided. Attached here are letters from Community Health Network, Franciscan Alliance, IU Health, St. Vincent Health & St. Vincent Medical Group, and the Suburban Health Organization that indicate that none of these organizations will accept the MCP model.

HIPAA Privacy Rule: The provisions of HIPAA are the first national standards for protecting health information. Read about protected information and the administrative requirements of HIPAA.

Claim Liability Notice: Pursuant to 760 IAC 1-68-16 (a), a multiple employer welfare arrangement (MEWA) is required to provide each participating employer this notice regarding claim liability.

PPACA Update and Discussion (as of July 2, 2015): Addresses the ACA Health Insurer Tax, Employer Penalties, New Employee Classification Issues and the Cadillac Tax.

PPACA Supreme Court Ruling Impact: Note on the impact to Indiana Municipalities based on the June 25, 2015 U.S. Supreme Court final ruling.

Supreme Court Upholds ACA Subsidies in Federal Exchanges: Quick facts about the June 25, 2015 U.S. Supreme Court final ruling in King v. Burwell that upheld the availability of subsidies in all states, including those that have federally facilitated Exchanges

Cadillac Tax Legislative Brief: A fact sheet on the excise tax scheduled to take effect in 2018 to reduce health care usage and costs

Health Care Lane: An interactive experience from UnitedHealthcare that features information on benefits, wellness, the Affordable Care Act and more

HIPAA Privacy Training: An overview of the federal rules for patient health privacy, including protected health information, disclosure rules, individual rights, administrative requirements, HIPPA enforcement and more

Final PPACA Regulations on Municipalities: The IRS published final regulations on the shared responsibility penalties under the Patient Protection and Affordable Care Act (“PPACA”) on February 10, 2014. The final regulations contain several modifications to earlier guidance.  This memorandum provides a summary of the significant issues relevant to Indiana cities and towns.
